How DigitalGate collects, uses, stores, protects and discloses personal information for website visitors, Platform users, organisations, connectors, AI features and Professional Services.

DigitalGate (“DigitalGate”, “we”, “our” or “us”) respects your privacy and is committed to handling personal information responsibly and in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where applicable.

This Privacy Policy explains how DigitalGate collects, uses, stores, protects and discloses personal information when you:

  • visit the DigitalGate website;
  • use the DigitalGate Platform;
  • create or manage a DigitalGate account;
  • use DigitalGate Apps or services;
  • connect third-party services to DigitalGate;
  • submit an enquiry or contact us;
  • participate in a Founding Customer programme;
  • purchase Professional Services or Support; or
  • otherwise interact with DigitalGate.

1. Who We Are

DigitalGate is an Australian technology company providing an AI-powered Business Operating Platform.

The DigitalGate Platform is designed to connect, centralise and intelligently manage business information, customers, workflows, websites, marketing, AI, automation, payments, analytics and industry-specific systems.

DigitalGate may also provide professional services including implementation, migration, training, consulting and customer success services.

2. Information We Collect

Depending on how you interact with DigitalGate, we may collect different categories of information.

Information you provide directly

This may include:

  • name;
  • email address;
  • telephone number;
  • business name;
  • ABN;
  • business address;
  • business and industry information;
  • account information;
  • job title or role;
  • website and domain information;
  • business goals and preferences;
  • information submitted through forms;
  • onboarding information;
  • support enquiries;
  • consultation information;
  • payment and billing information;
  • communications with DigitalGate; and
  • information you voluntarily provide to us.

Information within the DigitalGate Platform

Customers may choose to store or process business information through DigitalGate, which may include:

  • contacts;
  • companies;
  • leads;
  • opportunities;
  • customers;
  • tasks;
  • activities;
  • notes;
  • documents;
  • communications;
  • appointments;
  • properties;
  • accommodation information;
  • business information;
  • website information;
  • marketing information;
  • analytics;
  • transaction information; and
  • other information configured by the customer.

The information stored within a customer’s DigitalGate organisation may include personal information relating to the customer’s own customers, employees, prospects, suppliers or other individuals.

Technical information

We may automatically collect information such as:

  • IP address;
  • browser type;
  • device information;
  • operating system;
  • pages visited;
  • referral information;
  • usage information;
  • login activity;
  • Platform activity;
  • error and diagnostic information; and
  • security and audit information.

3. Information Customers Connect to DigitalGate

DigitalGate allows customers to connect third-party services and business systems.

Depending on the Apps and Connectors used, these may include services such as:

  • Google;
  • Google Business Profile;
  • Google Analytics;
  • Google Search Console;
  • Meta;
  • WordPress;
  • Stripe;
  • Xero;
  • property data providers;
  • property portals;
  • booking platforms;
  • email services;
  • hosting and DNS providers;
  • CRM systems; and
  • other supported services.

When a customer connects a third-party service, DigitalGate may receive information from that service in accordance with the permissions and authorisations granted by the customer.

Customers are responsible for ensuring that they have appropriate authority to connect and process information through their DigitalGate account.

4. How We Collect Information

We may collect information when you:

  • create a DigitalGate account;
  • purchase a subscription;
  • complete onboarding;
  • connect an integration;
  • submit a form;
  • contact support;
  • book a consultation;
  • request an audit;
  • purchase Professional Services;
  • use the Platform;
  • communicate with us;
  • participate in a Founding Customer programme;
  • subscribe to communications;
  • interact with our website; or
  • otherwise provide information to DigitalGate.

We may also collect certain information automatically through cookies, analytics, logging and similar technologies.

5. How We Use Personal Information

We may use personal information to:

  • provide the DigitalGate Platform;
  • create and administer accounts;
  • authenticate users;
  • manage organisations and permissions;
  • provide Apps and integrations;
  • provide customer support;
  • process subscriptions and payments;
  • communicate with customers;
  • provide Professional Services;
  • configure and maintain customer environments;
  • monitor Platform security and performance;
  • diagnose technical issues;
  • maintain audit and security records;
  • provide reporting and business intelligence;
  • improve the DigitalGate Platform;
  • develop new features and services;
  • provide AI-assisted functionality;
  • provide marketing communications where permitted;
  • analyse website and Platform usage;
  • prevent fraud and abuse;
  • comply with legal obligations; and
  • protect our rights and the security of the Platform.

6. Artificial Intelligence

DigitalGate incorporates artificial intelligence throughout the Platform.

Depending on the functionality being used, AI may process information supplied by a customer or generated through connected business systems to provide:

  • recommendations;
  • summaries;
  • reports;
  • content;
  • classifications;
  • lead analysis;
  • business insights;
  • workflow suggestions;
  • search and visibility analysis; and
  • other AI-assisted functionality.

DigitalGate may use third-party AI model providers to provide certain AI functionality. Where those providers are used, information may be processed by them in accordance with the applicable service configuration, contractual arrangements and privacy terms.

DigitalGate does not use customer information for unrelated purposes merely because it is processed through an AI feature.

DigitalGate’s AI pathway may involve internal context preparation and routing to one or more model providers. Specific retention, logging and training settings depend on the provider and configuration in use.

We continue to document provider arrangements as the Platform’s AI architecture matures. This Privacy Policy describes AI processing at a general level and does not invent guarantees about retention or training that have not been confirmed for each provider configuration.

7. Business Customer Data

Where a DigitalGate customer uses the Platform to store information about its own customers, employees, leads or other individuals, the DigitalGate customer is generally responsible for determining:

  • what information is collected;
  • the purpose for which it is collected;
  • the legal basis for collecting and using it;
  • obtaining any required notices or consents; and
  • configuring its DigitalGate environment appropriately.

DigitalGate processes this information primarily to provide the Platform and services requested by the customer.

Where appropriate, DigitalGate may act as a service provider or processor on behalf of the customer.

Customer-controlled business data (for example contacts, leads, documents and connected system records within a customer organisation) is distinct from DigitalGate account, telemetry, billing, security and product data that we collect to operate and improve the Platform.

Customer-controlled business data remains subject to the customer’s instructions and applicable law. DigitalGate’s own operational data is handled under this Privacy Policy for DigitalGate’s legitimate business purposes described above.

8. Cookies and Similar Technologies

DigitalGate may use cookies and similar technologies to:

  • operate the website and Platform;
  • maintain sessions;
  • remember preferences;
  • improve functionality;
  • understand website usage;
  • monitor Platform performance;
  • analyse marketing performance; and
  • improve user experience.

You may control or disable cookies through your browser settings, although certain functionality may be affected.

9. Analytics and Advertising

DigitalGate may use third-party analytics, advertising and measurement services, including services such as:

  • Google Analytics;
  • Google Ads;
  • Google Tag Manager;
  • Meta;
  • LinkedIn; and
  • other analytics or advertising providers.

These services may collect information about interactions with our website, advertisements or communications.

Their collection and use of information is governed by their respective privacy policies.

Where permitted by law and, where required, with your consent, DigitalGate may send:

  • Platform announcements;
  • industry insights;

  • promotional communications; and
  • other relevant business communications.

You can unsubscribe from marketing communications at any time using the unsubscribe mechanism provided or by contacting us.

Transactional and service-related communications may still be sent where necessary to provide the Platform or services.

11. Payment Information

DigitalGate may use third-party payment providers to process subscription and other payments.

Payment card information may be processed directly by the relevant payment provider rather than being stored directly by DigitalGate.

Payment information is handled according to the applicable provider’s terms and privacy policy.

12. Third-Party Service Providers

DigitalGate may use third-party providers for services including:

  • cloud hosting;
  • authentication;
  • databases;
  • email delivery;
  • AI services;
  • payment processing;
  • analytics;
  • error monitoring;
  • communications;
  • CRM functionality;
  • infrastructure;
  • DNS and domain services;
  • data enrichment;
  • property information;
  • booking integrations; and
  • other Platform functionality.

We seek to use providers appropriate to the services being delivered and take reasonable steps to ensure information is handled appropriately.

13. Overseas Disclosure

Some DigitalGate service providers may operate or store information outside Australia.

As a result, personal information may be transferred to or accessed from countries outside Australia.

Where required by applicable privacy laws, DigitalGate will take reasonable steps to address overseas disclosure requirements.

DigitalGate takes reasonable steps to protect personal information against:

  • unauthorised access;
  • misuse;
  • interference;

  • alteration; and
  • unauthorised disclosure.

Depending on the service, security measures may include:

  • authentication controls;
  • organisation-level access controls;
  • permissions;

  • security updates; and
  • other technical and organisational safeguards.

No internet-based system can be guaranteed to be completely secure.

Where information is no longer required, DigitalGate will take reasonable steps to delete, destroy or de-identify it, subject to applicable legal and contractual requirements.

You may request access to personal information DigitalGate holds about you.

You may also request correction of information that is inaccurate, incomplete or out of date.

DigitalGate does not sell personal information.

  • provide the DigitalGate Platform;

  • prevent fraud or abuse;

DigitalGate may provide links to or integrations with third-party websites and services.

DigitalGate does not control the privacy practices, security, policies or content of third-party services.

You should review the privacy policies of third-party services before providing personal information to them.

19. Children’s Privacy

DigitalGate’s Platform and services are intended for businesses and business users and are not directed towards children.

We do not knowingly collect personal information from children for the purpose of providing the Platform.

20. Privacy Complaints

If you believe DigitalGate has handled your personal information incorrectly, please contact us first so that we can investigate and attempt to resolve the issue.
